GenBioPro Statement Regarding Compliance With California Health & Safety Code § 119402

Notice: This information is provided pursuant to the requirements of California Health & Safety Code, Section 119402, which requires pharmaceutical companies doing business in California to make available their Compliance Program and to provide an annual written declaration of their adherence to the requirements of the Compliance Program.

GenBioPro, Inc., has established a Comprehensive Compliance Program (“the Compliance Program”) in compliance with the requirements of the California Health and Safety Code §§ 119400-119402 (“California Compliance Law”). The Compliance Program is in accordance with the "Compliance Program Guidance for Pharmaceutical Manufacturers" from the United States Department of Health and Human Services Office of the Inspector General (“OIG”) and includes policies consistent with the Pharmaceutical Research and Manufacturers of America (“PhRMA”) “Code on Interactions with Health Care Professionals.”

The purpose of the Compliance Program is to prevent and identify any potential violations of law or company policy. GenBioPro has established procedures to investigate, take disciplinary action, and implement corrective measures, as necessary.

The Compliance Program has been updated as of 3 July 2024 to reflect the latest updates and revisions to:

  1. OIG’s April 2003 Compliance Program Guidance for Pharmaceutical Manufacturers; and
  2. PhRMA’s Code on Interactions with Health Care Professionals.

The Compliance Program includes limits on incentives provided to medical or health professionals. The annual aggregate dollar limit on gifts, promotional materials, or items or activities that GenBioPro, Inc., may give or otherwise provide to an individual medical or healthcare professional is limited to $2,000. This amount does not include the value of pharmaceutical drug samples, grants for medical education, medical scholarships, professional service or consulting fees, patient education materials, and approved scientific reprints. This limit may be revised by GenBioPro from time to time.

Declaration of Compliance

GenBioPro declares, in good faith as of 3 July 2024, that it is committed to conducting its business ethically and in compliance with all applicable laws. To the best of its knowledge and based on a good faith understanding of the statutory requirements, GenBioPro has established a Compliance Program that meets the requirements set forth in the California Health & Safety Code, Sections 119400-119402. GenBioPro is, in all material respects, in compliance with the Compliance Program and with the respective established annual spending limit. GenBioPro will update this declaration on an annual basis, most recently as of 3 July 2024.
